Overview
This End User License Agreement ("Agreement") is a legal agreement between you ("User") and Daniil Postnov, operating as PixelHush ("Developer"), for the use of the PixelHush software application, including the macOS application, VS Code extensions, browser extensions, and any related components (collectively, the "Software").
License Grant
The Developer grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on devices that you own or control, subject to the terms of this Agreement.
Free tier. You may use the free version of the Software at no cost, subject to the feature limitations described on the PixelHush website. The free tier is provided for personal and commercial use.
Pro tier. Access to Pro features requires a valid, active subscription or a lifetime license key purchased through an authorized channel (currently Polar.sh). One license key entitles one user to use the Software on up to two (2) devices simultaneously.
Trial. New installations may include a limited-duration trial of Pro features. Upon expiration of the trial period, the Software reverts to the free tier unless a Pro license is activated.
What You May Not Do
You may not:
— Copy, modify, distribute, sell, lease, sublicense, or transfer the Software or any license key to any third party.
— Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software, except to the extent permitted by applicable law.
— Remove, alter, or obscure any proprietary notices, labels, or marks on the Software.
— Use the Software to develop a competing product or service.
— Share, publish, or redistribute license keys.
— Circumvent or attempt to circumvent any license verification, feature gating, or usage restrictions built into the Software.
Ownership
The Software and all copies thereof are the intellectual property of and are owned by the Developer. The structure, organization, and code of the Software are valuable trade secrets and confidential information of the Developer. The Software is protected by law, including but not limited to the copyright laws of the Republic of Uzbekistan and international treaty provisions.
No Warranty
The Developer does not warrant that the Software will detect all screen recording or screen sharing applications, nor that all sensitive data (including but not limited to API keys, tokens, passwords, and other credentials) will be successfully hidden in all circumstances.
The Software is a supplementary security tool and should not be relied upon as the sole method of protecting sensitive information. The User acknowledges that no software can guarantee complete protection against accidental exposure of sensitive data and assumes full responsibility for the security of their credentials and secrets.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the Developer be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with:
— The use or inability to use the Software.
— Any unauthorized access to or exposure of sensitive data, credentials, or secrets during screen recording, screen sharing, or any other screen capture activity.
— Any failure of the Software to detect a screen recording application or to hide sensitive data.
— Any interruption, suspension, or termination of the Software or any part thereof.
The Developer's total cumulative liability shall not exceed the amount actually paid by the User for the Software during the twelve (12) months immediately preceding the event giving rise to the claim.
Subscription and Payment
Pro subscriptions are billed monthly or annually through Polar.sh, which acts as the Merchant of Record. All payment processing, refunds, and billing inquiries are handled by Polar.sh in accordance with their terms of service.
Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through your Polar.sh account. Upon cancellation, Pro features remain available until the end of the current billing period, after which the Software reverts to the free tier.
Lifetime licenses are one-time purchases granting perpetual access to Pro features as available at the time of purchase and all subsequent updates.
The Developer reserves the right to change pricing for new subscriptions. Existing subscribers will be notified at least thirty (30) days before any price change takes effect on their account.
Data Collection
The Software operates locally on your device. The Software does not collect, transmit, or store your source code, API keys, tokens, passwords, or any other sensitive data.
The Software may transmit:
— License key validation requests to verify your subscription status.
— Anonymous, aggregated usage statistics (such as which recording apps were detected) if you opt in. This data cannot identify you personally.
— Update checks to determine if a newer version is available.
No personally identifiable information is shared with third parties except as necessary for license validation and payment processing through Polar.sh. For full details, see our Privacy Policy.
Software Updates
The Developer may release updates to the Software from time to time. Updates may be delivered through Homebrew, Sparkle, or other distribution channels. While the Developer intends to maintain and improve the Software, there is no obligation to provide updates, new features, or continued support.
Termination
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Software and destroy all copies in your possession.
The Developer reserves the right to revoke any license key if it is found to be shared, redistributed, or used in violation of this Agreement.
Open-Source Components
The Software may include open-source components subject to their own licenses. The editor extensions (VS Code, Cursor, Windsurf, Antigravity) are open-source under the MIT License and governed by their respective license terms. A list of additional open-source components is available upon request.
Nothing in this Agreement limits your rights under, or grants you rights that supersede, the terms of any applicable open-source license.
Governing Law & Disputes
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Uzbekistan, without regard to its conflict of laws provisions.
Any dispute arising out of or in connection with this Agreement shall first be attempted to be resolved through good-faith negotiation between the parties for a period of thirty (30) days. If the dispute cannot be resolved through negotiation, it shall be submitted to the courts of the city of Tashkent, Republic of Uzbekistan.
Miscellaneous
Entire agreement. This Agreement constitutes the entire agreement between you and the Developer regarding the Software and supersedes all prior agreements and understandings.
Severability. If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
Waiver. The failure of the Developer to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
Assignment. You may not assign or transfer this Agreement or any rights hereunder without the prior written consent of the Developer. The Developer may assign this Agreement without restriction.
Amendments. The Developer reserves the right to modify this Agreement at any time. Continued use of the Software after any modification constitutes acceptance of the modified terms. Material changes will be communicated through the Software or on the PixelHush website.
